TERMS AND CONDITIONS
CONDITIONS FOR GUIDED BICYCLE TOURS/EXCURSIONS
1. Services
The contractual services are valid when the customer confirms his booking and when Sunridetour confirms the customer’s booking or order, and are derived from the publicly listed conditions, e.g. on the Sunridetour website or Sunridetour flyers. Agreements other than normal contractual services require written confirmation by Sunridetour.
2. Bike tours/excursions
Exact adherence to the planned route and order of the tour/hike cannot be guaranteed. Therefore, Sunridetour reserves the right to change the route or content of the tour/hike in the event of impediments such as impassable paths/roads due to snow or rain or unsafe conditions, blockades or similar unforeseen events during the tour/hike. In this case, tour/hike participants will be informed immediately. Each guide can make appropriate changes to the tour/hike according to the required conditions. Tours/excursions take place regardless of weather conditions, provided that the safety of the participants is not at risk.
3. Payment
The tour/hike price must be paid in full prior to the start of the tour/hike.
4. Cancellations and booking changes
Customers may cancel tour/excursion bookings free of charge up to 30 days before the start of the scheduled event. After this deadline, the following cancellation fees apply:
No cancellation fee up to 30 days before the scheduled date. 10% cancellation fee up to 20 days before date, 50% cancellation fee up to 10 days before date, 75% cancellation fee up to 4 days before date, 90% cancellation fee up to 24 hours before date. No refund will be given for cancellations made less than 24 hours before the start of the tour. If the customer does not show up on the agreed date, there will be no refund.
Special rules in case of bad weather:
In the event of continuous heavy rain or unsafe weather conditions: Sunridetour may offer a replacement bike tour/hike in another area or find a new agreed date and time for the tour/hike; or an exception may be made to the cancellation conditions of the booking and allow a free cancellation. Please note that free cancellation of a tour/hike due to bad weather conditions, unsuitable or unsafe routes is only possible if agreed by e-mail with Sunridetour.
5. Safety
Customers participate in our tours/hikes at their own risk. Participants on tours/hikes must at all times comply with the Highway Code and the laws on the use and abuse of illegal substances such as drugs and alcohol. Sunridetour is not liable for injury or damage caused by wilful or negligent behaviour of tour participants, accidental falls and accidents occurring during tours/hikes. Participants must decide for themselves whether they are able or in an appropriate state to complete the tour/hike safely. During guided and self-guided tours/hikes and bicycle hire, a bicycle helmet must be worn when using the bicycle.
6. Limitation of liability
Sunridetour is not liable for damage caused by insufficient functioning of the bicycles provided by Sunridetour or private bicycles used during the tour/hike. Participants must check the efficiency of their bicycles themselves before the start of the tour/hike and inform the guide immediately if something goes wrong.
7. Reporting defects
In the event of insufficient or defective services, participants may request assistance. In this case, participants are obliged to notify Sunridetour by informing the guide or by calling Sunridetour on the indicated number. Sunridetour may refuse to provide assistance when the assistance requested is not directly related to the services provided. If the customer is responsible for not reporting defects, the customer’s claims may be invalidated in whole or in part.
8. Cancellation by Sunridetour
Sunridetour reserves the right to cancel an event without notice when a participant, despite fair warning to desist, behaves inappropriately during a tour/excursion. In this case, Sunridetour shall retain the amount paid for the tour/excursion (less any expenses not incurred and refunds through the service provider or other similar benefits obtained through other uses of the withdrawn services). Extra expenses incurred due to the discontinuation of the tour/excursion must be paid by the persons responsible for the discontinuation of the tour.
9. Privacy
All personal data made available to Sunridetour by the customer shall be processed electronically and shall be used exclusively for contractual or customer service purposes. Sunridetour is obliged to comply with the regulations of the European Data Privacy Regulation (GDPR) regarding the collection, processing and use of personal data. Please read the Privacy Policy carefully
10. Minimum age requirements
The minimum age for bicycle hire is 18 years. Young people and children under the age of 18 may only use the rented bicycles under the supervision of an adult. In this case, the adult concerned is responsible through his/her signature on the rental agreement.
11. Use of bicycles and bicycle accessories
The customer declares by his/her signature that he/she is in a condition to use the equipment and that he/she is aware of the rules of the road and is responsible for compliance with these traffic regulations both on and off the road. Without express written permission, the following is not permitted: to use the bicycles on downhill routes; to use the bicycles for freeriding, fourcross, dirt jumping or trial riding; to use the bicycles for sporting competitions; to re-hire the bicycles or bicycle equipment to third parties. The customer is obliged to guard the rented equipment against theft. When the rented bicycles are not in use, the renter is obliged to secure the bicycle to an anchored object (such as a bike rack or lamp post). The customer shall inform Sunridetour immediately in the event of loss or theft of the rented equipment. The customer shall be liable to pay the costs of the value of the equipment in the event of loss or theft. The customer is obliged to register cases of theft with the police and notify Sunridetour.
12. Limitation of liability
Sunridetour shall only be liable for limited damage to persons or property when the damage is clearly caused by Sunridetour or otherwise caused by the actions of Sunridetour. Such claims must be made directly to Sunridetour, at the latest with the return of the rented equipment. The exclusion of liability shall apply in the case of hidden defects or material defects. Sunridetour shall not be liable for damage caused to the equipment during the rental period.
13. Liability of the customer for damage to the equipment
The customer is obliged to return the rental equipment in good working order and without damage. Repair costs for damage to the rented equipment during the rental period shall be borne by the customer. Complaints must be made by Sunridetour upon return of the rental equipment. Repairs shall be carried out by Sunridetour. Repairs may not be carried out by the customer or third parties without the explicit approval of Sunridetour.
14. Accidents
If the customer is involved in a road or off-road accident, the customer must call Sunridetour for assistance, stating the exact location and details of the accident. In the event of an emergency, the customer must call the Italian emergency number 112.
15. General Rules
All agreements between the customer and Sunridetour shall be governed by Italian law. Should individual clauses of these Terms and Conditions be legally ineffective, this shall not affect the validity of the remaining clauses.
